Bidders must be over the age of 18 to be able to register. Please read the following terms and conditions carefully as by registering to bid at our auctions you agree to be bound by these terms and conditions. If you cannot commit to paying and picking up an item within our specified time periods, please Do Not Place a Bid.
1. Obligation to Purchase.
By placing a Bid at Auction, you are entering into a legally binding contract. A Bid placed at Auction, either online, by absentee or in person, is an offer to purchase. If you are the Winning Bidder, you are legally obliged to purchase the Winning Lot and pay any applicable fees and charges including the winning bid amount and any buyer’s premium.
2. Obligation to Collect
Within 48 hours of the time specified for each auction, you must collect your Winning Lots from our warehouse (unless you have arranged postage). If You cannot collect your items within 48 hours from the date of the Auction, you must contact us within that time frame. A storage fee may be charged. If after 14 days no contact has been made or the item has not been picked up, the ownership of the item will revert to ATT Auctions, and we reserve the right to offer the item to the second highest bidder or place it back up for auction.
3. Right to Inspect and Item Descriptions.
The buyer is encouraged to inspect any goods that they are thinking of bidding on; by visiting on our open days or by making an appointment. Potential buyers are also welcome to call and discuss any items they wish to place a bid on or to ask for further photos. If you choose to bid on an item that you have not inspected or researched, then you do so fully at your own risk. All sales are final. There will be no exchanges, warranties or refunds unless otherwise noted. All items are strictly sold “as is”. We have attempted to describe, photograph, and catalogue the items correctly, but neither warrants nor represents and in no event shall be responsible for the correctness of descriptions, genuineness, or condition of the items.
4. False or Misleading Conduct.
It is illegal to create a User Account & use a false name to buy items or make bids with an invalid or stolen credit card. Moreover, you must not engage in any form of bid manipulation. We will refer any fraudulent use of the User Account to the relevant law enforcement agency.
5. Dispute Resolution.
In the event of any dispute between Bidders for a Lot as to who Bid highest amount, ATT Auctions shall have absolute discretion to resolve the dispute. ATT Auctions’ decision shall be final and conclusive.
6. Agent/Vendors Rights.
We have the right to bid on behalf of any prospective bidder or bidders without disclosure.
7. Buyer’s Premium.
A Buyers Premium is a fee added to the Winning Bid price. This fee is retained by us for the service of receiving, appraising, listing (cataloguing and photographing) and auctioning the Lot. The Buyer’s Premium may vary; Buyer’s Premium is listed on each Auction Lot details page as a percentage.
8. GST.
Final prices are inclusive of GST unless otherwise stated.
9. Consequences of Non-payment.
If you do not pay the full Invoice Amount (in cleared funds) on or before the required Payment Due Date, then We reserve the right to:
(1) disable your account, preventing you from accessing the User; and/or
(2) bring court action against you for any outstanding amounts you owe, including any Buyer’s Premium and all reasonable costs incurred by us as a result; and/or
(3) resell the item in any manner we see fit.
10. Payment Methods.
Direct Deposit on invoice, or Cash, Credit/Debit Card on pick up.
